The present text has a contractual value. Each booking is registered and numbered by client and day. Each booking has an emergency plan in case of an accident, and Civil Liability Insurance and Accident Insurance. Each booking requires a minimum of 4 people to be made, in case the number is less, Alicante Aventura Experience S.L. will do everything possible to reach the minimum and that the activity takes place, if this is not possible, the client will be offered a change of day or activity. No activity will be carried out by Alicante Aventura Experience S.L. or using the material owned by Alicante Aventura Experience S.L. without the corresponding acceptance of these terms.

I am of legal age or I have the express written permission of my guardians or legal representatives. All the data provided in this form are truthful and are written legibly. In any other way I decline any responsibility on the part of Alicante Aventura Turismo Activo. The price of the activity will be fixed by Alicante Aventura Experience S.L. and paid in advance by me before the activity takes place. In case of non-appearance or delay on the day of the activity, of not being able to carry out the contracted activity for any health or safety reason, of non-compliance with any rule or instruction by the team of Alicante Aventura Experience S.L. or of not daring at the last moment to carry out the activity, I will lose the right to carry out the activity, as well as to any kind of refund or compensation by Alicante Aventura Experience S. L. The technicians and the people in charge of the activity will be in charge of the activity. L. It is the technicians and managers of Alicante Aventura Experience S.L. who, in the last instance, will evaluate and decide if there is any risk to my health, in case of any type of condition not previously specified, losing, if they deem it appropriate, the right to carry out the activity and/or to any type of refund or compensation on their part. I have received explanations from the technicians, guides or instructors regarding rules and instructions, as well as safety measures and my obligations. I understand, accept and will comply with all these rules and safety measures, as well as any additional instructions given to me by the guides or monitors during the activity. I am aware of the lack of regulation that some of the activities offered by Alicante Aventura Experience S.L. have and I assume the consequences that this could entail (cancellation of the event, fines or sanctions, loss of the right to reimbursement of the activity, complaints, injuries or any type of accident derived from the impossibility of developing the activity with the appropriate safety measures).

I do not suffer from any heart disease, epilepsy or any disease, illness or disability that would make it inadvisable for me to carry out the activity. I do not suffer from any mental disorder or disability. I am not pregnant. I have not consumed drugs nor am I under the influence of any narcotic substance. In case I am over 50 years old, or if requested by Alicante Aventura Experience S.L. (hereinafter Alicante Aventura), I have a medical certificate that guarantees that I can carry out this type of activity without any risk to my health. I assume full responsibility for any type of injury, damage or death that may be caused to myself or to third parties during the activity. I am responsible for the correct use of all the material that is used to guarantee my safety during the activity, following the indications, rules and instructions of use that have been provided to me as well as the correct use of the facilities where the activity takes place. I assume full responsibility for the consequences of my carelessness or disobedience of the warnings, instructions and rules provided by the organisation. I am aware that any mountain and adventure activity involves a real and inherent risk to this type of activity, considered of extreme risk, and I assume it under my full responsibility. I therefore release Alicante Aventura, as well as the members, owners of the facilities, guides, monitors, clients or companions who are carrying out any function within the activity, from total responsibility for any accident; for this reason I decline my right to file any type of lawsuit against any of these figures. I understand that the practice of extreme sports and the practice of sports in the natural environment cannot take into account all possible risk factors, so that any type of accident can occur under any circumstances.

In Alicante Aventura Experience S.L. we process the information you provide us with the purpose of providing the requested service and billing. The data provided will be kept as long as the commercial relationship is maintained or for the time necessary to comply with legal obligations and meet the possible responsibilities that may arise from the fulfilment of the purpose for which the data were collected. The data will not be transferred to third parties except in cases where there is a legal obligation. You have the right to obtain information about whether Alicante Aventura Experience S.L. is processing your personal data, so you can exercise your rights of access, rectification, deletion and portability of data and opposition and limitation to their treatment before Alicante Aventura Experience S.L., Ave/ País Valenciá, Nº8 CP 03570, Villajoyosa/Alicante, Spain or at the email address info@alicanteaventura.com, attaching a copy of your ID card or equivalent document. Likewise, and especially if you consider that you have not obtained full satisfaction in the exercise of your rights, you may lodge a complaint with the national supervisory authority by contacting the Spanish Data Protection Agency, C/ Jorge Juan, 6 – 28001 Madrid.

With the inclusion of new technologies within the communications, publications and commercial actions that Alicante Aventura Experience S.L. may carry out and the possibility that in these may appear the personal data and/or images that you have provided during the activity within the existing commercial link. And given that the right to one’s own image is recognised in article 18 of the Constitution and regulated by Law 1/1982, of 5 May, on the right to honour, personal and family privacy and one’s own image and Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of individuals with regard to the processing of personal data and the free movement of such data, Alicante Aventura Experience S. L asks for your consent to be able to publish the images in which you appear individually or in group that with commercial character can be made with our company. They also accept that the images taken by Alicante Aventura Experience S.L in the activity will be delivered to the clients within 48h or 96 h after the activity. I hereby authorise Alicante Aventura Experience S.L. to make commercial use of the personal data and my image provided within the commercial relationship with our company in order to be published on the website and on the company’s social media profiles, in films for commercial distribution and in photographs for magazines or publications related to our sector.

If the company cancels due to bad weather or any other reason, a 100% refund will be made.

In the event that the participant cancels their participation in an activity, they will be reimbursed as follows:

• 95% will be refunded if the cancellation is communicated ten days before the activity is due to take place. You have the option to change the day or activity without the option of a refund.
• 75% refund when the cancellation occurs between the 9th and 5th day prior to the activity. You have the option to change the day or activity without the option of reimbursement.
• 50% refund when the cancellation occurs between the 4th and 2nd day prior to the activity. You have the option to change the day or activity without the option of reimbursement.
• 0% refund of the amount paid when the cancellation occurs within 24 hours before the activity. You will not be allowed to change day or activity unless you can justify your cancellation.

This legal notice cancellation policy does not apply to partial payments for bookings. This means that the partial payment for the booking is non-refundable. You do have the option to change the day or use other activities.

Events

In the event that the Client cancels an accepted quotation, the following payment will be made:

• The initial payment of the reservation will be 25% of the total amount (modifications can be made with a maximum margin of 10 to 7 days before the activity).
• The total payment must be made at the latest 3 days before the event by sending the respective receipt.

Failure to comply with the above-mentioned points may lead to the cancellation of the activity/event at any time without the possibility of any refund.

Failure to show up on the day of the activity will not imply any refund of the amount paid. In addition, if 30 minutes before the scheduled time at a meeting point for an activity and if the client does not notify of the delay, Alicante Aventura Experience will abandon the meeting point and the amount of the reservation will not be refunded. Likewise, in case of delay with notice, Alicante Aventura Experience will shorten proportionally the development of the activity if it allows it.

In the event that the same day of the activity or the day before, the weather conditions pose a danger to the integrity of the participants, the activity will be postponed to another date at the proposal of the company, or the customer giving also the option to exchange the activity for another or to the refund of 100% of the cost of the activity.

Any modification or suspension of the activity once it has begun due to causes beyond the organisation’s control will not imply the reimbursement of any amount or the substitution of the activity, so we will try to start the activity in the most favourable conditions possible.

Gift vouchers are NOT refundable and have no expiry date.

In case of a change of activity: They can only be changed or combined among the following: Kayaking, Via Ferrata, canyoning, caving, caving, coasteering or bungee jumping, The following activities are exempt: Paragliding, horse riding, boat hire and jet skiing.

Alicante Aventura will not be responsible for the provisioning of the participants, except for those activities that indicate the contrary.
