GENERAL CONDITIONS FOR BOOKING ACTIVITIES

The present text has a contractual value between the service provider and the client who hires such services.

‘Service provider’ means the company ALICANTE AVENTURA EXPERIENCE S.L. (hereinafter referred to as Alicante Aventura) which carries out adventure activities, under any exploitation and/or management regime.

‘Adventure activities’ means the service of guiding a group of people in certain physical activities -terrestrial, aquatic and/or aerial- which are carried out in the open air, and which therefore allow the enjoyment of nature while exercising. They are characterised by a high level of inherent risk and the aim is to surpass oneself. This requires the development of physical qualities, motor skills, great general endurance and, above all, a great deal of psychological preparation and social bonds between participants.

Guiding’ means the personnel specialised in adventure tourism and nature-oriented tourism who lead groups of visitors in the different landscapes through adventure activities and interpretation of the natural heritage as a quality tourist service.

‘Booking’ means the contract of an adventure activity between Alicante Aventura and a client for the provision of one or more adventure services.

‘Booking ticket’ means the document validly issued by Alicante Aventura as proof of the contract of the activity.

These General Conditions are exposed and available to the public for consultation prior to the reservation and purchase of activities in digital format, on the website of the Company (https://alicanteaventura.com/)

Alicante Aventura will not be responsible for the provisioning of the clients, except for the activities that indicate the contrary.

Alicante Aventura is committed to provide services within the legal framework of the current regulations of Tourism and Active Tourism.

It is the guides and technicians of the Alicante Aventura Experience S.L. team who, in the last instance, will evaluate and decide if there is any risk to the health of the client, in case of any type of condition not previously specified, losing, if they deem it appropriate, the right to carry out the activity and/or any type of reimbursement or compensation on their part.

The client will receive explanations from the technicians or guides regarding rules and instructions, as well as safety measures and the client’s obligations.

The client understands, accepts and will comply with all these rules and safety measures, as well as any additional instructions given by the technicians or guides during the activity.

The client declares:

• Be aware of the lack of regulation that some of the activities offered by Alicante Aventura Experience S.L. have and assume the consequences that this may entail (cancellation of the event, fines or penalties, loss of the right to reimbursement of the activity, complaints, injuries or any type of accident resulting from the impossibility of developing the activity with the appropriate safety measures).
• Not suffer from any heart disease, epilepsy or any disease, illness or disability that makes it inadvisable to carry out the activity.
• Not suffer from any mental disorder or disability.
• Not be pregnant.
• Not to have consumed drugs or be under the influence of any narcotic substance.
• If you are over 50 years old, or if you request it to Alicante Aventura Experience S.L. (hereinafter Alicante Aventura), you must have a medical certificate that guarantees that you can carry out this type of activity without any risk to your health.
• To assume full responsibility for any type of injury, damage or death that may be caused to themselves or to third parties during the activity.
• To be responsible for the correct use of all the material that is used to guarantee their safety during the activity, following the indications, rules and instructions for use that have been provided to them, as well as the correct use of the facilities where the activity takes place.
• To assume full responsibility for any consequences arising from carelessness or disobedience of the warnings, instructions and rules provided by the organisation.
• Be aware that any mountain and adventure activity involves a real and inherent risk to this type of activity, considered of extreme risk, and assumes full responsibility for it. To release Alicante Aventura, as well as the members, owners of the facilities, technicians, guides, clients or companions who are carrying out any function within the activity, from total responsibility for any accident; for this reason they decline their right to file any type of lawsuit against any of these figures.
• Understand that the practice of extreme sports and the practice of sports in the natural environment cannot take into account all possible risk factors, so that any type of accident may occur under any circumstances.
• Be of legal age or have the express written permission of their guardians or legal representatives.
• All data provided in this form are truthful and are written legibly. In any other way, Alicante Aventura declines any responsibility on the part of Alicante Aventura.

Alicante Aventura is not responsible for the participant’s bags and belongings in case of theft or loss.

Each booking has an emergency plan in case of an accident, liability insurance and accident insurance.

There are complaint and suggestion forms available for participants at the reception of the Villajoyosa and Jávea offices.

For a booking to be confirmed, a minimum of 4 people is required. If the group is smaller, Alicante Aventura Experience S.L. will try to reach the minimum number to carry out the activity. If this is not possible, we will offer the client the option to change the date or choose another activity. No activity will be carried out without prior knowledge and acceptance of these terms by the client.

The ticket issued for each booking is personal and non-transferable and will be issued in electronic format. Therefore, each booking is registered and numbered by customer and day. Only people with a ticket and/or reservation for the date, time and activity indicated on both will be allowed.

Alicante Aventura offers adventure activities subject to its general, promotional and/or special rates, duly published in all sales areas, at the reception of the offices and on the website of the Company. Alicante Aventura reserves the right to modify these rates without prior notice.

The price of the activity will be fixed by Alicante Aventura Experience S.L. and paid in advance by the client before the activity takes place, at the latest 48 hours in advance.

The starting times of each activity are predetermined and available to the public for consultation prior to booking and purchase of tickets, in digital format, on the Company’s website (https://alicanteaventura.com/).

Alicante Aventura is entitled to modify the announced schedules and even suspend and cancel any activity due to security, organizational, meteorological or force majeure reasons.

Alicante Aventura will determine and inform of the ‘cut-off time’ for the acceptance of reservations, after which the reservation of activities that cannot be organized for its correct operation will be denied.

The client may cancel the contracted services, based on the following cancellation policy:

• Up to 48 hours before the activity starting time: 100% refund. You have the option of a gift voucher with no expiry date, change of day or activity, if you wish.
• Within 48 hours before the activity starting time: 0% refund. You have the option of changing the day or activity.
• Within 24 hours before activity starting time: No change or refund will be allowed without a duly justified cause.

In the event of a no-show at the scheduled departure time, the client will not be entitled to any refund of the amount paid, unless otherwise agreed between the parties.

The above cancellation policy does not apply to partial payments for bookings. In other words, partial payments are non-refundable, but can be used to change the date or for other activities. However, if the cancellation is made within 24 hours prior to the activity, there will be no refund or rescheduling option.

When the company cancels due to safety, organisational, weather or force majeure reasons, a 100% refund will be given. However, you will be offered the possibility of converting your booking into a gift voucher with no expiry date, change of date or activity.

The client has the right to communicate any non-compliance or disagreement with the service provided during the activity, as soon as possible, in writing to info@alicanteaventura.es.

Alicante Aventura reserves the right to modify the timetables, dates and/or type of activity, with prior communication and acceptance by the client.

Alicante Aventura is not responsible for the personal belongings and objects of the clients.

GENERAL CONDITIONS FOR EVENTS

BOOKING

In order to formalise the reservation, a prepayment of 50% of the total amount is required (modifications can be made with a maximum margin of 10 to 7 days before the activity).

Full payment must be made no later than 3 days before the event by sending the respective receipt.

Quotations are valid for 15 days from the date they are sent, unless otherwise stated in the quotation.

Failure to comply with the above points may result in the cancellation of the activity/event at any time without the possibility of reimbursement.

When the company cancels due to security, organisational, meteorological or force majeure reasons, 100% will be refunded. However, you will be offered the possibility of converting your booking into a gift voucher with no expiry date, change of date or activity.

CANCELLATION BY THE CLIENT

When the activity is cancelled by the client, once the quote has been accepted, the refund will depend on how far in advance notice is given:

• More than ten days in advance, 100% of the total amount will be refunded.
• Between ten and seven days in advance, 50% of the total amount is refunded.
• Within the previous seven days: 0%.

No-show on the day of the activity will not entitle the customer to a refund. If the client does not show up at the meeting point 30 minutes before the established time and does not give notice of the delay, Alicante Aventura Experience will leave the place and the amount of the reservation will not be refunded. In case of delay with prior notice, the duration of the activity will be reduced proportionally, whenever possible.

In the event that the same day of the activity or the day before, the weather conditions pose a danger to the integrity of the participants, the activity will be postponed to another date at the proposal of the company, or the client, giving also the option to change the activity for another one or to the refund of 100% of the cost of the activity.

Any modification or suspension of the activity, for reasons beyond the company’s control, once it has begun, will not entitle the client to a refund or replacement of the activity. However, we will always try to start the activity in the best possible conditions.

In the event that the company cancels the activity for any reason not attributable to the client, the client will have the right to a refund of the amounts paid, the issue of a gift voucher with no expiry date or the carrying out of the activity on another day.

When the cancellation of the activity is due to force majeure, understood as those circumstances beyond the control of the company and unforeseeable, in this case, the client will receive a gift voucher, without expiry date, for the same amount paid to be exchanged on another date of the client’s choice, or a 100% refund.

The client has the right to communicate any non-compliance or disagreement with the service provided during the activity, as soon as possible, in writing to info@alicanteaventura.es.

Alicante Aventura reserves the right to modify the timetable, dates and/or type of activity, with prior communication and acceptance by the client.

Alicante Aventura is not responsible for the personal belongings and objects of the clients.

Gift vouchers are NOT refundable and have no expiry date.

In case of a change of activity: They can only be changed or combined among the following: Kayaking, Via Ferrata, Canyoning, Caving, Caving, Coasteering or Bungee jumping. The following activities are exempt: Paragliding, horse riding, boat hire and jet skiing.
